Upick is a platform that connects customers with independent towing and roadside assistance operators. By using Upick, you agree to these Terms of Service.
Upick operates as a network and technology platform. Upick is not a traditional towing company and does not directly perform towing or roadside services unless explicitly stated otherwise. Services available through the platform may be provided by independent operators.
You must be legally able to enter into a binding agreement and use the platform in compliance with applicable laws. If you create an account on behalf of a business, you represent that you have authority to do so.

Users are responsible for maintaining the confidentiality of account credentials and for activity occurring under their accounts. Upick may suspend or terminate access if misuse, fraud, policy violations, or safety risks are suspected.
Customers may be charged service-related amounts, and operators may be subject to platform fees or other deductions where applicable. All payment-related terms, including estimates, quotes, final charges, and payout timing, may be governed by the specific transaction or platform settings in effect at that time.
Operators using Upick may be independent businesses or contractors and not employees, agents, or partners of Upick unless explicitly stated otherwise.

Upick may modify, suspend, or discontinue features at any time. We do not guarantee uninterrupted availability of all platform functions.
The platform is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Upick disclaims warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, Upick will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, goodwill, data, or business opportunities arising from use of the platform.
You agree to defend, indemnify, and hold harmless Upick and its affiliates from claims, liabilities, damages, losses, and expenses arising out of your use of the platform, your services, your content, or your violation of these terms or applicable law.
Upick may suspend or terminate access at its discretion if these Terms are violated or if use of the platform presents legal, operational, or safety concerns.
These Terms are subject to applicable law and may be updated from time to time. Continued use of the platform after changes become effective constitutes acceptance of the updated terms.
